When trying to pursue a claim for asbestos-disease compensation, the first issue is identifying where you were exposed to asbestos.
For some people this is easy, they worked directly with asbestos and can provide detailed evidence of their work that required them to handle asbestos or asbestos materials on a day to day basis.
For others, it is not so easy. If they did not work directly with asbestos they may not be aware of what kind of asbestos was being used, where it was in their work environment or how they came to be exposed by it.
In order to make a claim for compensation, potential Claimants need to be able to provide evidence of their exposure to prove that a company was negligent in allowing them to be exposed to the deadly substance.
Italian case found novel tracking method
A recent case in Italy found an unusual method of tracking asbestos exposure.
Eleven textile workers were diagnosed with mesothelioma but were not aware of any exposure to asbestos. They had been producing sewing threads and had not worked directly with asbestos.
Without knowing where their asbestos exposure had come from, none of the workers were able to claim compensation for their incurable asbestos cancer.
Company carried out works at the plant
It was not until works were carried out at the plant the workers had been at that everything became clear. The plant was full of asbestos and a specialist asbestos removal company had been brought in to remove it.
Researchers examined the annual reports from asbestos removal companies as far back as 1988. The law in Italy means the companies are required to report where any asbestos is removed from, as well as how much is taken.
When combining the reports with the testimony of the workers, the research team was able to reconstruct the workplace and track where the workers had been exposed to asbestos.
Lead researcher, Alessia Angelini, said; “The new collected information depicted a widespread asbestos pollution of the workplace during the period of employment of all cases.”
Workers were able to claim compensation
Thanks to the work of the researchers, the workers were able to access the compensation they were entitled to.
