A former student developed Peritoneal Mesothelioma 25 years after he left education having attended various schools in the Devonshire Area.

He attended Yeo Valley Primary School, Yeo Valley Junior School, South Molton Juniors and Moulton Community College between 1982 and 1993 and alleged that he had been exposed to asbestos whilst at these schools.

He has successfully claimed compensation for his condition. His claim settled out of Court for £275,000 without an admission of liability.  This is the first case where a former pupil has pursued a claim against an Education authority for exposure to asbestos whilst in school.

An inspection programme was set up last year by the Health & Safety Executive to assess schools in the Devon area for levels of asbestos. The results showed that 20 schools assessed were found to need enforcement action for asbestos related hazards.

Asbestos was used widely in construction works as a building material between the 1950s and 1980s across the UK. It is, therefore, the case that much asbestos is still present in buildings and it lays dormant until it is disturbed, when re-constructive work is carried out or when an area of asbestos is removed.  This can trigger the fibres to become airborne and as a result, a dangerous hazard to health.

With the onset of mesothelioma,symptoms are often subtle and these do not become noticeable and develop until the cancer cells begin to grow. Once this happens, symptoms can include:-

Pleural mesothelioma

  • Pain in back and side of chest
  • Shortness of breath
  • Persistent cough
  • High temperature

Peritoneal mesothelioma

  • Pain in the abdomen
  • Feeling or being sick
  • Poor appetite
  • Diarrhoea or constipation

However as these symptoms are very general, your symptoms could easily be mistaken as something less trivial and that is why it is important to visit your GP.
