The Diffuse Mesothelioma Payment Scheme (DMPS) was launched in 2014 to provide compensation for people diagnosed with mesothelioma caused by exposure to asbestos at work, who are unable to pursue a claim against their employer.

To be eligible for the scheme applicants need to:

  • Have been diagnosed with diffuse mesothelioma on or after 25th July 2012;
  • Have been exposed to asbestos whilst working in the UK;
  • Be unable to trace the employer or insurer for the company that exposed them to asbestos;
  • Have not made a civil claim for compensation.

Each year the scheme is reviewed and the annual review for 6th April 2019 to 5th April 2020 has now been released.

Statistics for 2019 to 2020

There were 315 applications during this period. This is the lowest number of applications since the scheme was launched in 2014.

88% of applicants were male and 12% were female. This is the highest percentage of female applicants ever. This follows the trend of more women being diagnosed with mesothelioma in recent years.

Of the 315 applications submitted, 79% were successful, 18% were unsuccessful and 3% were withdrawn. Following rejection, 5 cases were reviewed and all received different results, most likely due to further information being provided for the review.

The average payment was £144,000 which is £4,000 less than the previous year.

A total of £32.7million was paid out to nearly 250 applicants.

How is the scheme funded?

The DMPS was set up to fund those who cannot claim compensation from their previous employers. Even if the companies are dissolved, if insurance can be traced, civil claims can be pursued. However, in some cases, insurance cannot be traced and this is often due to the inadequate records kept by the insurance industry.

Due to the poor record keeping, the scheme is paid for by the Employers Liability Insurance Industry. Each year the insurers pay a levy based on the demand for the scheme.

Should I instruct a solicitor for a DMPS claim?

You can make the application yourself, however, we would recommend you instruct a solicitor to assist. This will take the pressure off you at what will already be a stressful time for you and your family.

In order to make a claim you need to show that no civil claim can be made, this can require extensive company research and insurance searches to be done. These are things we do every day and may be difficult for someone without expert knowledge.

The scheme tariffs include a sum of £7,000 for solicitors’ fees and if you instruct our solicitors, the fees payable will not exceed £7,000, even if the work done exceeds this.
