We have been successful in ensuring justice for our client Mrs W who sadly lost her husband due to asbestosis. Mr W had previously settled his claim for compensation for his asbestosis back in 2017 and had done so on a provisional damages basis, meaning that when his condition worsened he was able to return for further compensation. Sadly, his condition did deteriorate and Mr W sadly passed away. His wife contacted our expert team to ask us to pursue a return claim on behalf of his estate. We were keen to ensure justice for her and the family in these tragic circumstances.
Original claim dealt with by other solicitors
Even though our team had not dealt with the original claim, Helena Cameron was able to pick up the case and run it to a successful conclusion for Mrs W, ensuring her further justice and the compensation owed to her for the sad and untimely loss of her husband.
Further medical evidence was obtained to support the claim from the expert instructed in the original claim which confirmed that Mr W’s respiratory disability had increased significantly and ultimately resulted in his life expectancy decreasing by three years due to the progression of his asbestosis.
Grant of Probate obtained
A Grant of Probate was also required in this claim to ensure the estate were eligible to receive the compensation and our probate lawyers were able to deal with this in house, recovering the costs directly and meaning Mrs W had full support in all areas of the legal process.
Sadly, Mrs W developed early onset dementia, necessitating additional care and assistance, which her husband would have of course provided to her had he been around to do so. We included a claim for Mrs W’s own care to make sure she was looked after going forward, including moving to sheltered housing with on-call support.
Whilst this is clearly a tragic case, we are pleased to have been able to support the family and provide them with financial stability following what must have been a very difficult time in their lives.
