Initial Instructions and Employment History
We were initially instructed when Mr S was still alive. At the outset, we gathered full details regarding his employment history and exposure to asbestos. Mr S’s Work at St Thomas’s Hospital
Mr S had been employed as a labourer at St Thomas’s Hospital in London. He worked on the construction of the new north wing, a thirteen-storey block. His work as a labourer included general tasks such as digging holes and mixing cement. Additionally, he was involved in distributing building materials, including asbestos, around the site.
Exposure to Asbestos
Mr S described how he would transport asbestos sheets to other tradesmen, such as joiners, who would use them in the construction. He provided a clear and detailed description of the asbestos sheets and recalled how dusty they were. This regular exposure to asbestos was a key factor in holding the Defendant negligent and in breach of their statutory duty.
Mr S’s Diagnosis and Passing
Over time, Mr S began experiencing breathlessness. Initially, he was diagnosed with a benign pleural effusion and pleural thickening. Unfortunately, it was later confirmed that he had mesothelioma. Tragically, Mr S passed away before the claim could be completed. However, with the benefit of his detailed witness evidence, we were able to continue pursuing the claim on behalf of his wife.
Outcome of the Claim
We obtained medical evidence to support the claim and successfully recovered £190,000. Our legal fees were paid separately, and the family now has the peace of mind knowing that the deceased’s widow will not have to worry about financial concerns in the future.
