Successful claim for the family of a mesothelioma sufferer

We have been successful in claiming compensation on behalf of our client, Mrs Y, who sadly lost her husband to mesothelioma. Despite the Defendants being slow to respond, we continued to pursue the claim to a successful conclusion for the Estate of Mr Y.

Exposure to asbestos

Mr Y was heavily exposed to asbestos dust during the course of his employment with Platt and Co. Limited as a fitter at their Oldham factory in the late 1960’s. He was also exposed to similar levels of asbestos dust during the course of his employment with Ferranti Engineering Limited in the late 1970’s as a fitter at their factory in Hollinwood.

The Defendants were negligent and found to be in breach of statutory duty in exposing Mr Y to substantial quantities of asbestos dust causing him to develop sarcomatoid mesothelioma, which ultimately led to his early passing.

Deterioration in health

Our client’s husband was an incredibly fit, bright and active man prior to suffering with troubling breathing problems during June of 2019. His breathing problems quickly progressed over a period of 8 weeks, ultimately resulting in him needing to be admitted to hospital.

He underwent an unpleasant pleural drainage procedure and developed significant left-sided chest pain, resulting in the need for opioid analgesia to be prescribed. Sadly, he rapidly deteriorated and was bed-bound for a number of days until he sadly passed away. The sarcomatoid mesothelioma, which is considered to be the most aggressive form of the disease, was found to have caused his sad passing and cut short his otherwise anticipated life expectancy by 4 and a half years.

Because our client’s husband was in such good health before falling ill with his asbestos-related condition, it came as a great shock to him and his family as he began to suffer with his cancer. He also had to resign his previously independent lifestyle and accept care and assistance from his family and from a hospice.

As well as compensation for the disease itself, we were also able to claim on behalf of our client for the tasks that her husband previously attended to, for example gardening and cleaning.

Offers in settlement

The Defendants in this matter were not forthcoming with an offer for a long time and so we initiated alternative dispute resolution starting with a reasonable offer of £125,000.

Unfortunately, the response received was considered to be a severe undervalue of the claim in light of how terribly the client’s husband had suffered. After a period of negotiation, during which we vigorously pursued the Defendants for a reasonable offer, a final settlement figure was agreed at £115,000.
