We were contacted by the family of Mr B who sadly passed away in December 2018. The family suspected that asbestos had contributed to his death and wanted to claim on behalf of his Estate.
Limited employment details
In claims where someone has passed away before a witness statement can be taken, it can be difficult to get the necessary details for a claim. In this case, the deceased’s son had a limited knowledge of his father’s work history and our expert solicitors were able to piece together enough information to allow a claim to be pursued.
Asbestos exposure at dockyard
Between approximately 1961 and 1966, Mr B worked for Alfred Holt & Co Limited, now called Exel Limited, as a gang leader at a dockyard. He and his colleagues regularly unloaded sacks of raw asbestos fibre from ships before it was transported around the UK to be used in construction.
Settled despite arguments from the defendant
This was not an easy claim and throughout the defendant raised issues on breach of duty and causation, arguing that they were not responsible for the deceased’s asbestos condition.
Despite the arguments from the defendant, we were able to argue our case and negotiate a settlement of £5,000 for the deceased’s family.
