Seeking Justice After Asbestos Exposure: A Window Cleaner’s Story

When Mr D reached out to our team, it was soon after the heartbreaking loss of his brother to mesothelioma – a fatal cancer caused by asbestos exposure. 

How Exposure Happened 

Mr D’s brother worked for decades as an industrial window cleaner for C J Lewis & Sons, between 1974/75 and 2001. Having worked alongside him, Mr D could provide crucial firsthand details about the environments and tasks that caused asbestos exposure – evidence that would prove essential for the claim. 

Their work took them to the Turners Asbestos Cement factory in Widnes, known for producing corrugated asbestos roofing. Each month, they spent two full days cleaning windows inside and outside the factory, which was operating at full capacity. The windows were covered in asbestos dust, and they had no protective gear or masks throughout these years. 

The Devastating Diagnosis 

For most of his life, Mr D’s brother was healthy. But in December 2022, a persistent cough led him to his GP. Initially treated as a simple chest infection, further investigations revealed mesothelioma. 

Despite medical intervention, including fluid drainage from his lung, his condition deteriorated rapidly, and he passed away just months later. 

Taking Legal Action 

As executor of his brother’s Will, Mr D instructed our dedicated asbestos claims team to pursue a case. Once the claim was submitted to C J Lewis & Sons’ insurers, liability was admitted quickly, confirming that the asbestos exposure had occurred during his brother’s work. 

Securing Compensation 

We successfully achieved a £113,000 settlement for the family, which covered:

  • Funeral costs 
  • Loss of earnings, as Mr D’s brother was still working when diagnosed 

The Broader Lessons
