We recently succeeded in settling a claim for mesothelioma compensation following the sad passing of Mr S. We had initially been instructed when Mr S was alive and so were able to take full details of his employment history and exposure to asbestos. Quite quickly, John Laing and Son Limited were identified as the Defendant in this case and the party responsible for having exposed Mr S to extensive amounts of asbestos.
Exposure at London Hospital
Mr S had been employed as a labourer based at St Thomas’s Hospital in London working on the construction of the new north wing, a thirteen-storey block. His work as a labourer involved general tasks such as digging holes and mixing cement, but he was also involved with distributing building materials around the site, including asbestos.
He described taking asbestos sheets to other tradesmen such as the joiners who would use them in the construction. He was able to provide a clear description of the asbestos sheets and recalled how dusty they were. This had been a regular occurrence during his period of employment and was enough to hold the Defendant negligent and in breach of their statutory duty.
Lifetime Evidence Preserved the Claim
Mr S had begun to suffer with breathlessness and was initially diagnosed with a benign pleural effusion and pleural thickening. Sadly, it was later confirmed that he had mesothelioma and Mr S died before we could complete the claim. However, with the benefit of his very helpful witness evidence obtained during his lifetime, we were able to continue to pursue the mesothelioma claim for his wife. We obtained medical evidence in support of the claim and were able to recover a sum of £190,000. Our fees were paid in addition to the compensation and the family are now able to put the claim behind them. Although no amount of money can compensate for the loss of Mr S, his family do have the comfort that his widow does not have to worry about money in the future.
