At Asbestos Justice we are delighted to report that we have recently succeeded in an application under the Diffuse Mesothelioma Payments Scheme (DMPS) for Mrs H, who tragically lost her husband and soul mate to the devastating disease earlier this year.
Mr H worked for Tennison & Bates (Hull) Limited between 1963 and 1966/67 as an apprentice joiner and was regularly exposed to airborne asbestos dust when being told to saw through asbestolux sheets in completely unprotected conditions. He suffered further exposure when fitting the cut pieces and when sweeping up the mess he had created at the end of his working day.
Claim Difficulties
Unfortunately, Mr H passed away quickly after being diagnosed with his mesothelioma, before he could sign his draft witness statement prepared by his specialist asbestos disease solicitor at Asbestos Justice.
Further, no insurance could be located for the business covering his period of work, but we relied on the fall-back scheme under the DMPS which allows those affected by the disease and their surviving dependents to claim significant sums of compensation even where no insurance can be located for offending employers.
Witness Evidence Relied Upon
Mr H’s draft witness statement was attached as an exhibit to his son’s signed witness statement which provided a full description of how he came into contact with a great deal of airborne asbestos dust when working for Tennison & Bates. This was relied upon in support of the DMPS application which was filed in June of 2023 on behalf of Mr H’s surviving widow.
No Requirement for a Post-Mortem
As is the coroner’s prerogative after a person has passed away, they decided to refrain from ordering a post-mortem to take place as Mr H’s condition has been confirmed by way of pleural biopsy during life. Asbestos Justice assisted the coroner in acquiring Mr Hall’s histology records from his treating hospital which were used at the time of the inquest.
Swift DMPS Approval
Well within 3 months of submitting the DMPS claim form to the scheme administrator, Asbestos Justice received notification that Mrs H’s DMPS claim would be approved, resulting in her receiving a significant sum of compensation, far in excess of £130,000.00, with her legal costs also being covered under the scheme.
