Diffuse Mesothelioma Payment Scheme Success

At Asbestos Justice we are delighted to advise that we have recently succeeded in a claim under the Diffuse Mesothelioma Payment Scheme (DMPS) for Miss P who was sadly diagnosed with the incurable asbestos related cancer during April of 2024 after undergoing a biopsy procedure. 

No insurance = DMPS Claim  

Miss P could recall coming into regular contact with harmful amounts of airborne asbestos dust when working for  Plastercraft Limited at their factory in Darwen Lancashire, which later changed its name to Conver Foam Limited before eventually being bought out by the Harrison Jones Group of companies. After undertaking extensive company and insurance investigations, unfortunately, we were unable locate Employer’s Liability insurance for Miss P’s employer, which triggered the need to pursue her mesothelioma claim through the DMPS. 

Deadly Dust Exposure  

Asbestos lagged heating pipes ran through the factory and over time the lagging became damaged and degraded, resulting in large amounts of asbestos dust and debris dropping to the floor, which our client and her colleagues were tasked with cleaning up with yard brushes. In particular, she remembered having to do this after a fire at the factory site. Evidence we obtained in support of her mesothelioma claim showed that this type of activity resulted in large clouds of airborne asbestos dust rising up into our client’s working environment, resulting in her breathing in the deadly dust in entirely unprotected conditions for approximately 18 months from 1976 onwards. 

DMPS approval  

Miss P’s DMPS application was filed with the scheme provider, Davies Casualty on an urgent basis, shortly following receipt of news of her diagnosis during April of 2024. We had to act swiftly because, if she passed away without the application being filed during her lifetime, her estate would be unable to bring a mesothelioma claim under the scheme. 

The application was approved under the scheme in a little under 4 months. Miss P now intends to fully retire from work after receiving news of her successful DMPS claim, which will result in her receiving almost £170,000 in mesothelioma compensation to assist her over the course of her period of suffering. 

Thankfully, Miss P was considered fit enough to receive immunotherapy treatment on the NHS which has resulted in significant regression of her mesothelioma and all of us here at Asbestos Justice wish her well with her ongoing treatment.
