At Asbestos Justice, we are proud to have secured £100,000 in asbestosis compensation for Mr K after building a detailed and robust case that proved his asbestos exposure from more than 50 years ago had caused his illness.

Although Mr K’s exposure dated back to the 1960s and 1970s, our specialist team was able to trace the evidence needed to establish his claim, obtain expert medical and engineering reports, and successfully recover compensation while protecting his future should his health deteriorate.

Reconstructing Decades-Old Asbestos Exposure

Mr K instructed Asbestos Justice after being diagnosed with asbestosis, an asbestos-related lung disease that had left him struggling with breathlessness and reduced mobility.

Our first task was to investigate where and how he had been exposed to asbestos many decades earlier.

Working closely with Mr K, we took detailed witness evidence about his employment history, identifying prolonged asbestos exposure while he worked as both an apprentice and qualified boilerman for A.R. Adams & Son between 1963 and 1972.

His evidence revealed that he regularly removed deteriorating asbestos insulation from pipework in dusty, unventilated conditions without any respiratory protection or warnings about the dangers of asbestos.

We also investigated his later employment with Girling Limited, where asbestos brake linings were used.

Rather than pursuing every potential defendant regardless of the evidence, we carefully assessed the merits of each claim. After reviewing the available evidence, we advised that almost all of Mr K’s asbestos exposure had occurred during his employment with A.R. Adams & Son. Concentrating the claim against the employer responsible for the overwhelming majority of his exposure strengthened the case and ensured Mr K’s claim focused on the evidence with the greatest prospect of success.

Obtaining the Medical Evidence Needed to Prove the Claim

Successfully bringing an asbestosis claim requires more than simply proving asbestos exposure. It must also be established that the exposure caused the disease.

To do this, we obtained independent expert evidence from both a consultant radiologist and a consultant respiratory physician.

Following specialist investigations, including detailed lung function tests and a High-Resolution CT (HRCT) scan, the experts confirmed that Mr K had developed asbestosis caused by his occupational asbestos exposure.

The medical evidence showed permanent scarring to his lungs together with reduced lung function, explaining the breathlessness that now affects his everyday life.

Importantly, the specialists also confirmed that Mr K faces an increased risk of developing other serious asbestos-related diseases in the future, including mesothelioma and asbestos-related lung cancer.

Going Further with Independent Engineering Evidence

Because we wanted to present the strongest possible case, we didn’t stop at obtaining medical evidence.

We also instructed an independent engineering expert to assess the level of asbestos exposure Mr K experienced during his employment.

The engineer concluded that Mr K’s exposure was exceptionally heavy and significantly exceeded the level recognised by medical experts as being capable of causing asbestosis.

This additional expert evidence provided powerful independent support for the claim and reinforced the link between Mr K’s working conditions and his diagnosis.

Protecting Mr K’s Future

Our work did not end with securing compensation.

Given the medical evidence showing Mr K remained at risk of developing further asbestos-related diseases, we negotiated a settlement on a provisional damages basis.

This was particularly important because it protects Mr K’s future.

As well as recovering £100,000 in compensation, he has preserved the legal right to return and claim further compensation if he later develops mesothelioma, asbestos-related lung cancer, diffuse pleural thickening or if his asbestosis significantly worsens.

This gives him valuable peace of mind that he will not lose the opportunity to seek further compensation should his health deteriorate.

Following the successful conclusion of his claim, Mr K left the following review on Trustpilot:

“What a wonderful firm of very helpful professionals, they truly are true to their word. I would not hesitate to recommend them.”
