Exposure with Express Insulations Limited  

Witness evidence we obtained in support of the mesothelioma claim confirmed that Mr D was employed by Barker & Wears, trading as Express Insulations, based in Fareham, Hampshire, as a lagger and metal cladder during the 19977/78 tax year. 

This company specialised in asbestos removal. The directors were Patrick Wears and Michael Barker. 

One of Mr D’s main tasks involved lagging and cladding pipes with non-asbestos-containing materials. However, he also worked overtime, typically outside normal working hours, removing old asbestos lagging. 

On one major contract he worked on was at Cyanamids GB in Gosport, when he assisted with asbestos removal with tools, resulting in asbestos dust clouds contaminating Mr D’s clothing, hair, and skin. There was no exhaust ventilation system. Wire brushes were used to clean remaining residue, further releasing asbestos dust into the air. 

Further danger was created by Mr D being instructed to frequently sweep up asbestos dust and debris with a yard brush for approximately 30 minutes per day. 

A basic rubber-type mask and paper overalls were provided to Mr D by the company, but no battery-operated filters or formal mask-fitting sessions were offered and he was never warned of the dangers of asbestos exposure by the company either, all of which was relied upon as proof of negligence in this mesothelioma claim. 

Further exposure with T.S. Insulations Services Limited  

Mr D also worked for this company as a lagger and metal cladder and was based in Locksheath, Hampshire. The directors were Dave Harris who is believed to have died from asbestosis and another individual by the name of Pat Bundy. 

On a major contract at Graylingwell Psychiatric Hospital in Chichester, West Sussex, Mr D was exposed to old asbestos lagging dust daily over a six-week period. His work involved removing deteriorated grey and blue asbestos lagging, which measured up to 3 inches in thickness, from pipework in the ducts. The confined conditions trapped the thick, airborne asbestos dust which Mr D inhaled throughout the course of the working day. 

Once again, he and others used a variety of tools to smash away at the asbestos lagging on the pipes which resulted in clouds of asbestos dust rising up into the confines of the ducts, which covered his work clothes, hair and skin. There was nowhere for the dust to escape and this was a regular part of his work for the company on this contract which lasted around 6 weeks approximately in total. 

After removal, he cleaned the pipework using wire brushes as he had done before. He then painted over the pipework with a form of sealant to contain any asbestos fibres before they were re-lagged. He also swept the work areas with normal yard brushes, creating further clouds of airborne asbestos dust, before bagging the waste asbestos to be transported outside. 

Mr D participated in sweeping the dirty areas with a yard brush, creating additional airborne dust. He was involved in daily sweeping for 30 minutes, up to two hours at a time on each day. 

Although areas were designated as “clean” and “dirty” with a shower between them, the shower often did not function, and overalls were removed in the dirty area only which was relied upon as further proof of negligence in this claim for mesothelioma compensation. 

The Claimant wore paper overalls and a basic mask, not equipped with battery-operated filters and without a formal mask-fitting session.
