At Asbestos Justice, we are delighted to report that we have recently succeeded in an important case for our client, Shirley Heath relating to her diagnosis of mesothelioma.
Background
In April of 2025, Shirley was sadly diagnosed with asbestos-related pleural mesothelioma after undergoing months of medical investigations following a build-up of fluid around her left lung. The diagnosis came as a devastating shock to her and her family, particularly because her father had died from the same disease back in 2014.
Before falling ill, Shirley had always enjoyed good health. She worked part-time as a gardener, remained physically active, and spent much of her free time hiking, walking her dogs and assisting with Duke of Edinburgh expeditions. She also enjoyed regular trips to the theatre with her loving husband, Richard.
Childhood Exposure
Although Shirley never worked with asbestos herself, she was exposed to asbestos dust as a young child as a result of coming into contact with her father’s contaminated work clothing and person relating to his work for Norwich City Council during the 1966/67 tax year.
Her father worked as a carpenter and spent several months fitting and cutting asbestos-containing Asbestolux insulation boards on a council construction project. The work created significant amounts of dust, which settled on his clothing, hair and skin throughout the working day. At the time, he was given no warnings about the dangers of asbestos and was not provided with any respiratory protection.
Each evening, he returned home wearing the same dust-covered work clothes. As a young child, Shirley spent a great deal of time in close contact with her father, who would collect her from childcare, carry her home, play with her and care for her while her mother worked evenings.
The family lived in a small bungalow where contaminated clothing was regularly brought into the home and washed by hand. Dust was released during laundering and household cleaning activities, causing further asbestos dust to contaminate the family home.
Fighting Back
After undergoing numerous hospital investigations, including scans, biopsies, specialist consultations and several hospital admissions, Shirley made the difficult decision to undergo major surgery in June 2025 to remove as much of her mesothelioma as possible. She also received and intensive course of chemotherapy treatment and experienced significant side effects, including fatigue, sickness and reduced stamina.
The illness had a profound impact on her quality of life. She had been unable to work since January 2025 and was unable to take part in many of the activities that previously formed an important part of her life. Even routine tasks around the home have become more difficult due to breathlessness and the effects of her treatment.
Her surgery was invasive and it took many months following the procedure for Shirley to recover.
Time to Reflect
Shirley reflected on her experience following her diagnosis recently and her words perfectly capture the emotional impact that sufferers face.
When she was diagnosed in 2025, she found herself confronted with a bewildering amount of information, support services and decisions. Although these resources are invaluable, she recalls feeling unable to engage with any of them. She said:
“I didn’t want to join support groups, I didn’t want to faff about choosing from a list of recommended solicitors, I didn’t even want to read the information leaflets. Put simply, I didn’t want to dwell on the fact that I had cancer. I just wanted it all to go away.”
Having already lost her father to mesothelioma, the diagnosis came as an especially cruel blow to her and her husband, Richard. Understandably, much of the year that followed was spent processing the shock of what had happened.
Fortunately, her sister was able to put her in touch with our team. Because we had previously represented members of her family, there was already a level of trust and familiarity at a time when everything else felt uncertain.
The Need to Appoint a Specialist Asbestos Disease Solicitor
Reflecting on that period, she described how important it was to have someone guide them through the process. She added:
“The fact that my sister was able to find your details and put us in touch with you was the next best thing. I found your existing links to and previous knowledge of our family an enormous comfort and I felt the whole process was as non-invasive as it could have been.”
Our role was to investigate the circumstances of her asbestos exposure, secure early financial support and pursue compensation whilst Shirley focused on her treatment and recovery.
Throughout the claim, she underwent major surgery and chemotherapy, facing the physical and emotional challenges that come with treatment for mesothelioma.
Amazingly, Shirley was told following a recent scan following her surgery that she was free of her mesothelioma which was such fantastic news.
We were delighted to secure a successful settlement on her behalf. While compensation can never undo a diagnosis, it can provide security and access to treatment options in the future, as Shirley further explained:
“Although I’m currently cancer free, I know that realistically it’s a difficult one to cure. The settlement you secured means that if and when the disease returns, we can at least go into it knowing I’m receiving the best care available.”
The Stage was Set
One of the most remarkable moments in her journey came recently when she and Richard were invited to attend Irwin Mitchell’s thoracic symposium attended by leading clinicians and healthcare professionals.
Expecting an informal discussion, they arrived to discover a packed conference venue complete with a stage, large screen, lectern and microphone.
Her surgeon had asked her to share a few words about her experience. Despite her surprise, she spoke candidly about her diagnosis, treatment and recovery. Richard was then invited to speak about the legal journey and the support they had received throughout the claims process from ourselves.
What followed was something neither of them could have imagined when she was first diagnosed.
Introduced to the audience as a success story, they found themselves at the centre of an event celebrating advances in mesothelioma treatment and patient outcomes. There were photographs, flowers and even a trophy presented to commemorate her remarkable progress.
Recalling the occasion, she joked that if someone had shown her this moment during the darkest days of her illness, she would have assumed it was an hallucination.
Most importantly, she left the event with something that had seemed impossible just a year earlier: Hope. She concluded:
“Here I am. Currently cancer free. I’m not going to pretend the surgery and chemotherapy weren’t tough or that there hasn’t been a price to pay, but we are going into the next phase feeling stronger all the time and as best prepared as we can be for what may come.”
For our team, stories like Shirley’s are a reminder of why this work matter so much. Mesothelioma claims are not simply about compensation. They are about helping people regain a sense of control at a time when life feels anything but predictable.
We could not be prouder to have supported Shirley and Richard throughout their journey and will be forever grateful for the trust they placed in us during such a difficult period. We wish them both all the best as they move forward into the next chapter of their lives.
