Mr B worked on a full-time basis for Cape Universal Building Products Limited on Talbots Lane, Watford as a moulder for a period of around 6 to 12 months. The company was most recently known as Plumefern Limited.
Heavy Exposure with Cape Universal
During the course of Mr B’s employment, Cape were involved in the manufacture of various asbestos products, including the moulding of asbestos which was mixed with water before setting to form heated flue pipes, gutters, terminals and asbestos roofing materials out of moulds on the factory floor.
Mr B was always based on the production line, in the middle of factory and there was no ventilation system in place. There were closed sky lights in the ceiling there, but no windows to open at all.
The raw asbestos powder would arrive on site and be poured into machines on the production line, these combined the raw material with water to form a paste like mixture, which would then be poured into moulds to make the different products. Mr B was only a short distance away from the machines, attending to his own duties which involved wet moulding the products, when this process was done. The moulds would then be placed through dryers to set into place and the material would harden.
Mr B also worked around 15 feet away from workers who were involved in sanding down the dried out asbestos fittings and pipes throughout the course of each working day. They used sanders, which were hand abrasive files to do to this work, giving he products a smooth finish, this work created a great deal of asbestos dust would rise up into the atmosphere which covered Mr B’s work clothes, hair and skin.
Mr B could see thousands of airborne asbestos dust particles in the general environment throughout the course of his working day. To support his claim, we drafted a detailed witness statement in which he described the dust as very fibrous and hanging in the air before settling on machinery and the floors.
No Respiratory Protection Provided
Breathing in the airborne asbestos dust at Cape’s factory was a daily occurrence for Mr B and he was never warned of the dangers of being exposed to airborne asbestos dust, nor was he ever provided with any form of breathing protection to wear either. This was relied upon as further evidence of the negligence of his former employer.
Asbestosis Compensation Recovered
