Exposure to Asbestos When Working as a Lab Technician
Our client worked for Formica Limited which was based on North Shields, Tyne and Wear. The company was a laminate manufacturer and he worked for them as a laboratory technician and technologist, developing laminates.
He worked in close proximity to a sawyer who regularly cut up asbestos boards as part of the process for developing laminates, in entirely unprotected conditions.
Interim Payment Secured
A letter of claim detailing the circumstances of Mr S’s exposure to asbestos was sent to the Defendant on the 9th October 2023, with witness evidence and his biopsy report being provided to the Defendant’s insurers in November of 2023. An interim payment on account of damages of £50,000 was secured during April of 2024, at which time supportive medical evidence and the schedule of loss, detailing Mr S’s financial losses, were also disclosed.
Oncology evidence was obtained in support of our client’s private treatment claim which set out a plethora of treatment options which he can explore in the knowledge that it will be the Defendant, which must pay for the associated costs involved.
Substantial Private Treatment Costs Covered
After arguments were made with regards to the value of the claim, with reference to past case law and the JC guidelines, the Defendant eventually agreed to settle the claim for a sizeable sum of £270,000.00 gross of deductible CRU benefits plus the costs of and relating to future private medical treatment on the 7th July 2024. The claim was settled just over 6 months after receiving initial instructions.
To date, our client has incurred private treatment costs in excess of £100,000.00 which has helped to reduce the size of his tumour and improve the quality of his life. All such treatment has been paid for by the Defendant insurers as part of the favourable settlement in this mesothelioma claim.
