Shell Exposure
Our client worked for Shell U.K. Limited at Stanlow’s Oil Refinery, Ellesmere between 1969 and 1980 as a process operator and suffered regular exposure to harmful amounts of airborne asbestos in entirely protected conditions.
As well as an initial home visit, James went the extra mile for this client by visiting Mr P at his home address on other occasions, for example to go through detailed letters and provide face-to-face advice at this request.
A letter of claim, detailing the circumstances of our client’s exposure to asbestos, was sent out to Shell on the 17th January 2024, with supportive medical evidence and the schedule of loss detailing all the financial losses Mr P had suffered, being sent to their insurers on the 17th May 2024.
Case Settled and Private Treatment Costs Covered
Following detailed arguments on the value of the claim, supported by references to past case law and the Judicial College Guidelines, the Defendant ultimately agreed to a substantial settlement. On 5th June 2024, the claim was resolved for £300,000.00 gross of deductible CRU benefits, in addition to covering the costs of future private medical treatment.
The claim was settled just over 6 months after receiving initial instructions. The favourable settlement not only ensures that the client does not have to worry about his and his wife’s finances, but also gives him the peace of mind of knowing that he can claim for any treatments his oncologist recommends, even those which are only available on a private paying basis.
Mr P is now almost 12 months into his NHS course of immunotherapy and has generally responded very well to this treatment. However, this is only available on the NHS for 2 years in total and therefore, he may well need to exercise the private treatment option in the future and we will, of course, help him with this.
