We have recently settled a claim for mesothelioma compensation. Mr. B. was exposed to asbestos during the course of his employment and over 40 years later received the devastating diagnosis that he had developed malignant mesothelioma in the lining of his lung.
At present there is no known cure for mesothelioma and, as the disease is often detected at a late stage, treatment options can be limited. As part of the claim, we recovered compensation for the usual losses but were also successful in recovering the private treatment costs for immunotherapy treatment, which has, in recent years, increasingly been shown to be an effective treatment for mesothelioma.
Treatment plan
Mr. B. had undergone several sessions of chemotherapy but his tumour was progressing. We suggested that he speak to his Oncologist about the possibility of trying immunotherapy treatment. This was something which had been loosely discussed several months previously but dismissed because of the cost of the treatment. Mr. B. discussed the alternative treatment with his Oncologist and advised that funding could now be made available through his legal compensation claim. The Oncologist assessed Mr. B. as being a potential candidate for the treatment and it was arranged quickly so that the window of opportunity was not missed. Mr. B. underwent two sessions of the treatment before settlement was reached with the Defendant in the claim. It was then successfully negotiated that the settlement should include the costs of the immunotherapy treatment for as long as it was recommended by the Claimant’s treating oncologist.
Reimbursement
As his solicitors, we have remained involved to ensure that the treatment costs are regularly reimbursed. We have a system with the hospital whereby the invoices for treatment are sent as each cycle takes place, every 3 weeks. We seek reimbursement from the Defendant through their solicitors for the treatment invoices and all connected consultations.
Success
After 4 sessions, Mr. B. had a scan which showed that the mesothelioma had shrunk. After a second round of 4 sessions, further shrinkage of the tumour has been shown. This is great news. It would not have been possible for our client to have this treatment without funding provided by the claim as he simply did not have the money available. So far treatment and consultation costs have totalled almost £60,000, all paid for by his previous employer. This has without doubt extended his life expectancy and has brought huge relief to him and his family at what has been a very worrying time. We hope to be able to help many more clients in a similar way in the future.
Other treatments
The terms of the settlement were not limited to the cost of immunotherapy but extend to any such private treatment which may be considered appropriate in the future. As mesothelioma research continues to develop, we hope that this will bring new treatment options.
