Here at Asbestos Justice we succeeded in securing asbestos compensation for Mr W’s estate and widow. Mr W had been previously exposed to asbestos leading to him sadly developing the asbestos related cancer.

Mr W was able to pursue a mesothelioma claim as a result of his exposure to asbestos which occurred during his employment as an apprentice joiner with J Jarvis & Sons, before becoming a Joiner with Fosters Limited, Fisher Builders and Kestrel Kitchens. Unfortunately, when Asbestos Justice was instructed, Mr W had already passed directly as a result of his asbestos related condition. We were therefore instructed by his widow to pursue a mesothelioma claim for asbestos compensation arising out of her husband’s tragic death.

Mr W had worked for these companies from the late 1950s through to the 1980s. As a result of the historic employment history we were unable to locate any employer’s liability insurance cover for Fosters Limited, Fisher Builders and Kestrel Kitchens, during our client’s periods of employment. Fortunately, however, we were able to locate insurance with J Jarvis & Sons.

The horrendous cancer, mesothelioma, can develop following exposure to one single asbestos fibre. On the basis that Mr W had been exposed to more than minimal exposure to asbestos with J Jarvis, we were able to pursue the mesothelioma claim against them and recovered the full amount of asbestos compensation from this company’s insurers as mesothelioma is treated as an indivisible condition in law.

Whilst the mesothelioma could be linked to Mr W’s time with J Jarvis, as he worked for the company before 1965, we were required to show that he had been exposed to substantial quantities of asbestos dust during the course of his period of work in order to succeed in establishing liability in the mesothelioma claim.

Such examples of substantial asbestos exposure included working on asbestos lagging, where huge quantities of deadly asbestos fibres were said to have been released into the atmosphere.

Evidence gathered in support of the mesothelioma claim showed that Mr W had worked alongside laggers, working on asbestos pipework, during a three year job based in South Kensington when working for J Jarvis and Sons Limited. This was enough to indicate that he was likely to have been exposed to substantial quantities of asbestos dust, thereby supporting the claim for asbestos compensation.

This mesothelioma claim settled just before trial, where Asbestos Justice managed to secure a figure of £210,000.00 of mesothelioma compensation on behalf of the widow. This compensation helped in a small way to provide Mr W’s family with financial security and ensured that the Defendant was held to account for Mr W’s tragic passing.
