We have successfully pursued a claim for mesothelioma compensation for Mr M who contacted us after he was diagnosed with the incurable asbestos related cancer.

When Mr M developed a persistent cough he saw his GP who prescribed cough medicine and, when this did not help, a course of antibiotics. This treatment also failed to assist resulting in Mr M returning once again to see his GP. Having walked to the surgery, he was out of breath when he arrived and after listening to his chest, the GP sent Mr M straight to A&E. A chest x-ray was done and this showed a build up of fluid in his lungs which was removed and sent away to be tested. The results unfortunately confirmed that he was suffering with asbestos related mesothelioma.

Mr M was exposed to asbestos during the course of his employment with just one company, Sipson Caravans Limited in West Drayton. He was employed as a caravan fitter between 1952 and 1967 approximately.

His work involved fitting kitchens in caravans and a main part of his work involved cutting sheets of asbestos to line the cooker recesses and the fireplaces. Mr M used a handsaw to cut the asbestos sheets and as he did this, asbestos dust and fibres were released which he inhaled. Mr M’s employers did not provide him or his colleagues with any protective breathing equipment to prevent them from being exposed to harmful asbestos fibres.

Sipson Caravans was the only company that exposed Mr M to asbestos and by the time he was aware that he was suffering with an asbestos related condition, the company had dissolved and had ceased trading. You cannot claim compensation from a dissolved company unless you are able to find insurance that was in place at the time a person worked for a polluting company. Thankfully, after carrying out extensive searches, we were able to trace insurance for the company and a mesothelioma claim was pursued against the traced insurers.

Less than 12 months after opening Mr M’s file we were able to send him a cheque for over £110,000 in settlement of his mesothelioma claim. Whilst we know that no amount of money can make up for the pain and suffering caused by a mesothelioma diagnosis, Mr M was able to ensure his family had a secure future financially, giving him some peace of mind and a sense that some form of justice had been secured.
