Our client, Mr S W, brought a mesothelioma compensation claim as a result of his negligent exposure to asbestos whilst working at the HM Dockyard, Chatham from 1955 to 1964 approximately. He initially joined this site in 1955 as an Apprentice Shipwright. After this initial period of two years, he was then transferred to work directly on the ships, operating in very close proximity to laggers. He remained in this role for the entirety of his period of employment.
Whilst he was working next to the laggers he was within a very dusty environment as clouds of asbestos fibres hung in the air. Unfortunately, he could not help but inhale the asbestos which was constantly all around him. Due to the huge amount of asbestos released into the air, our client’s clothes and hair would be turned white as the asbestos dust settled and this was confirmed in his witness statement which was prepared in support of the mesothelioma claim.
Mr S W’s exposure to asbestos was exceptionally high for a large number of years. However, to bring a mesothelioma compensation claim, it is only necessary to show that there has been more than a minimal amount of asbestos exposure to establish blame. Here our client was clearly, negligently exposed to asbestos, resulting in his mesothelioma diagnosis.
Fortunately, the Defendant did not deny that they had negligently exposed our client to asbestos and we were happy to agree settlement of his mesothelioma claim for a total of £125,000. Whilst this does not atone for his negligent exposure to asbestos, this has provided a measure of comfort to our client and his family from a financial point of view and will assist with his care needs.
