Mr I was regularly exposed to asbestos when working aboard ships as a painter an decorator for Clelands (Successors) Limited at the Clelands Shipyard, Willington Quay, Swan Hunter Group PLC at their shipyard in Wallsend and for Cail’s Bitmo Co Limited, Quayside, Newcastle-Upon-Tyne during the 1950’s and 1960’s.
Dusty working conditions
We obtained witness evidence from Mr I which confirmed that he had been regularly exposed to a large amount of asbestos dust as a result of working next to others who removed asbestos lagging near to where he was working. He was also directly exposed to the harmful material when sanding asbestos lagging down himself before painting it. He was never provided with any form of mask to wear when working for the companies and was completely unaware of the dangers involved at the time. He would be covered in the asbestos dust by the end of the working day.
We obtained medical evidence from a well-respected Consultant Respiratory Physician who confirmed that Mr I’s exposure had materially contributed to the risk of the development of his mesothelioma. The expert also suggested that Mr I may be fit enough to undergo private medical treatment in the future to help combat his disease.
Our client completed 5 cycles of chemotherapy treatment which curtailed progression of his disease.
Private treatment costs covered
Whilst one of the Defendants doubted that Mr I would be considered for private treatment in the future, including but not limited to, immunotherapy treatment such as Keytruda, we obtained an opinion from his treating consultant, which confirmed that there was nothing in his past medical history which would restrict his ability to try this.
Mr I received a substantial sum of mesothelioma compensation to help him in the future, which included a claim for his care and assistance. In addition, the door is now left open for him to claim private treatment costs back from the successfully pursued the Defendants. His case was run to a successful conclusion in 6 months.
This mesothelioma claim shows that succeeding in such claims is not simply a matter of recovering money by way of compensation for clients, but also now regularly involves a real need to secure the right for their recommended private treatment to be paid for by offending Defendants and their insurers, to give them the best possible opportunity to fight their disease.
