Asbestos Justice dealt with a claim for mesothelioma compensation for Mr R who was employed by British Rail between 1959 and 1993. We have regularly pursued British Rail’s successor, the Department for Transport for mesothelioma compensation.

Mr R started work there as an electrician, then became a dual-trained fitter, then a rolling stock inspector and finally a Depot Supervisor. He was employed at British Rail’s Carlisle Upperby Depot at first and then at their Carlisle Kingsmoor maintenance Depot.

He was exposed to asbestos in his employment in a number of ways. In the early days of his employment at Upperby he was in close proximity to where the steam locomotives were being repaired. He was within feet of these whilst they were being repaired. There was blue asbestos used for lagging the boilers and the fireboxes on the steam locomotives. The asbestos lagging had to be removed whenever the pipes needed maintenance. The blue asbestos lagging would be removed and left on the shed floor. Our client would walk through the asbestos debris, from time to time cleaners would sweep it up. A lot of blue asbestos fibres were released into the air in the sheds when the asbestos was removed, in particular as it had been dry and brittle due to the extreme heat it had been though in the working steam locomotive. Blue asbestos is considered to be the most harmful form of asbestos and was commonly encountered by those seeking asbestos compensation.

Our client was also brought into contact with asbestos when he worked on the diesel multiple units. He worked on these in the carriage sheds. The engine was situated underneath the frame. The power car of the diesel multiple unit, where the engines were situated, was placed over a pit so that our client could work on the underframe. He would stand in the pit and work on them. There was blue asbestos between the engine and the frame of the unit. It was approximately three inches thick and it was blue asbestos but very oily and dirty. Our client would have to disturb this asbestos. There were clips holding the electric cables and fire detecting pipe in place. Mr R would have to remove those clips to work on the cables and pipes and so he would have to move the asbestos away from the clips. Sometimes he would cut sections of the asbestos away and it would fall onto the floor. Our client would spend hours working in this way covered in asbestos dust.

Our client also came into contact with white asbestos rope in the diesel locomotives. It was wrapped around the two exhaust pipes situated inside the locomotive on top of the engine. These exhaust pipes were about ten feet long. Our client had to work on the exhaust pipes if the joints blew apart or if he worked on the cylinders. The exhaust pipes would have to be removed so that he could get to the components he needed to work on. Each section of the exhaust pipe was wrapped in asbestos rope. Our client would handle this. The rope was brittle and easily decomposed. The rope was damaged and had holes in. When working on the exhaust pipes on top of the engine he worked in a confined space of about two and a half feet by twelve feet and he was in very close proximity to the asbestos rope.

Mr R’s description of his asbestos exposure was typical for a mesothelioma claim involving exposure to asbestos in the locomotive industry where workers were exposed to harmful amounts of asbestos dust on a regular basis.

At no time during his employment was our client provided with a mask, or given any advice or warnings about the dangers of working with asbestos.

We were able to secure an interim payment of mesothelioma compensation for our client within a few months of being contacted and Mr R received a total mesothelioma compensation sum of £125,000.00 within 6 months of instructing us to deal with his asbestos claim.
