First job after leaving school
Mr Y suffered negligent exposure to asbestos dust during his employment with Edgar Fitton & Co Limited who were based on Seymore Grove, Trafford Bar, Manchester as an apprentice heating engineer. He worked for the company from July of 1959 at the age of 15 until March of 1968.
The company was involved with commercial heating boilers and heating schemes and Mr Y
spent the majority of his time with the company working at customer sites. He worked at various locations for the company including at different schools, hospitals, swimming pools and public buildings, where he encountered a large amount of airborne asbestos dust in his work. As an apprentice at the age of 15, he was always given the dirty, dusty, less skilled and horrible jobs to do.
Stripping asbestos lagged boilers
It was a common occurrence for Mr Y to be instructed as an apprentice to strip and dismantle boilers which were then inspected and either replaced or re-fitted. He remembers the asbestos lagging around the boilers and pipework leading from them to measure approximately three to four inches in thickness. This was of a whitish to greyish colouration and it commonly looked in an old, degraded state. This activity was extremely dusty and led to him breathing in substantial quantities of asbestos dust, without any respiratory protection being offered to him. This was relied upon as proof of blame in the successful mesothelioma claim
Insurance traced to pay compensation
Using our experience as experts in the field of asbestos disease claims, we were able to locate insurance coverage for Mr Y’s employer and pursued the urgent claim against them as the company no longer traded.
We also obtained an urgent medical report from an expert respiratory physician who supported the mesothelioma claim.
