At Asbestos Justice, we are delighted to report that we have recently succeeded in a Diffuse Mesothelioma Payments Scheme (DMPS) application for Mr B who was sadly diagnosed with the incurable asbestos-related cancer in July of 2019.
Exposure in the 1970s
Mr B’s witness statement showed that he was employed with Richardson’s Developments Limited, Warley, West Midlands between 1973 to 1980 approximately where he carried out brickwork on Fields Farm Road, Long Eaton, Nottingham for a time. It is here that Mr B came to be exposed to airborne asbestos dust, without any respiratory protection being offered to him.
When investigating the claim, there were some initial complications, as Mr B’s work history from the Inland Revenue did not refer to Richardson’s on his work history as an employer.
Further evidence needed
Further evidence in support of the claim for mesothelioma compensation was detailed in his witness statement, which confirmed that whilst he paid his own tax, he was treated very much like an employee. He was expected to work set hours for set pay and was unable to leave the site freely. It was the company which provided workers with asbestos materials to do this job and his work was overseen by a superior, directly employed with the company. We believed this evidence satisfied the so called “control test” and therefore, Mr B would be seen as an employee in law.
No insurance traced
However, after carrying out insurance searches, no cover could be identified for Richardson’s. We therefore filed Mr B’s case on an urgent basis on the DMPS through Topmark Claims. As we had prepared the statement so fully and obtained documentation proving Mr B had worked for Richardson’s exclusively for 7 years, the application for mesothelioma compensation under the scheme was approved.
This is our fastest, successful DMPS application to date, with our client receiving news of his victory, just 31 days after he instructed us to act.
