Asbestosis Compensation Claims
Asbestosis is a chronic lung disease caused by exposure to significant quantities of asbestos. This usually takes place over long periods of time. Heavy exposure to asbestos can cause fibrosis, or scarring of the lungs. If sufficient exposure to asbestos can be proven, in many cases we are able to support a link with the fibrosis. Confirming a diagnosis of asbestosis can be a complicated matter. Fibrosis, or scarring of the lungs, is a condition which can be caused by things other than asbestos. In order to prove that the fibrosis is asbestos-related, we need to prove a very heavy history of exposure to asbestos, such as that seen with asbestos laggers or those who worked in asbestos factories. There are some clinical signs which may assist in linking the fibrosis to asbestos exposure, such as a sub-pleural predominance, however much is based on the level of asbestos exposure. - Asbestos exposure
Our expert solicitors will go through your work history with you and see which companies exposed you to asbestos. To help with this, we will request your HMRC schedule of employment from the Inland Revenue. This will detail all your employers and the dates you worked for them. For a successful asbestosis claim you will need to be able to show you were exposed to significant amounts of asbestos over a prolonged period. There are two aspects to each claim:

- Special damages
This relates to any financial losses you have suffered as a result of your diagnosis. This can include:
- Loss of earnings (if you are/were still working at the time of your diagnosis and are no longer able to continue working);
- Care and assistance, (if your condition has progressed to the point where you are no longer able to do some things for yourself) whether it be privately paid nursing care or care provided by a family member. This includes assistance with attending medical appointments, shopping, housework and gardening;
- Adaptation costs, including stair lifts;
- Travel expenses, including travel to and from medical appointments (make sure you keep a note of your appointments, mileage/taxi fares etc.).
